Section 781 of P.L. 119-37

Section 781 of P.L. 119-37 changes the federal definition of hemp. Most provisions take effect December 11, 2026 under P.L. 119-103, and the exclusion for cannabinoids not capable of being naturally produced by the plant applies from November 12, 2026. The new definition measures total THC, including THCA, limits final products to 0.4 mg of total THC per container, and excludes cannabinoids synthesized or manufactured outside the plant. Delta 8 distillate is made by converting hemp-derived CBD, so it is one of the product types most directly affected by the exclusion for cannabinoids manufactured outside the plant. Confirm the status of your own products and markets before Section 781 takes effect.

What is Compliant Delta 8 distillate?
Compliant Delta 8 is a specialty grade made with tighter reaction control and extra refinement passes to keep Delta-9 THC as low as possible, which makes it harder to produce than amber, gold or clear. Every batch is tested by KCA Laboratories, a third-party cannabis testing lab, at 0.3% or less Delta-9 THC, and many batches test non-detect. Every Delta 8 grade we sell ships with its batch COA, including the Delta-9 result.
Is Delta 8 distillate legal?
Hemp-derived Delta 8 distillate is federally Farm Bill compliant when produced from hemp testing under 0.3% Delta-9 THC and meeting the Federal Food, Drug, and Cosmetic Act requirements. However, state regulations vary significantly: some states have explicitly banned or restricted Delta 8, others have specific testing or labeling requirements, and many have no specific regulation. Buyers are responsible for verifying state and local regulations in destination markets before shipping.
